This End User License Agreement ("Agreement") is between you ("User") and YoDaddyDesigns LLC ("Licensor") for the use of EMTDrill ("the App"). By downloading or using the App, you agree to the terms of this Agreement. If you do not agree, do not download or use the App.
Licensor grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple devices that you own or control, solely for your personal, non-commercial educational purposes, subject to the terms of this Agreement and the Apple Media Services Terms and Conditions.
You may not:
All content within the App, including questions, answers, explanations, flashcard text, drug references, protocols, scenarios, graphics, user interface design, and software code, is owned by YoDaddyDesigns LLC and is protected by copyright, trademark, and other intellectual property laws.
The App stores study progress, quiz results, bookmarks, and preferences locally on your device. Licensor does not collect, access, or store any user data on external servers. See our Privacy Policy for details.
The App is an EMT certification exam preparation tool and does not guarantee certification, employment, or any particular outcome. The App is not affiliated with, endorsed by, or sponsored by the National Registry of Emergency Medical Technicians (NREMT). The App does not provide medical or clinical advice. Content may not reflect the most current clinical guidelines, drug information, or local protocols. Users should always defer to formal training, their medical director, and current local protocols when providing patient care.
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO PATIENT CARE OUTCOMES OR EXAM RESULTS.
IN NO EVENT SHALL LICENSOR'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP.
This Agreement is between you and YoDaddyDesigns LLC only, not with Apple. Apple has no obligation to furnish maintenance or support services for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Apple is not responsible for addressing any claims relating to the App or your possession or use of the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation.
Apple and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right to enforce this Agreement against you as a third-party beneficiary.
This license is effective until terminated. Your rights under this license will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.
This Agreement shall be governed by the laws of the United States, without regard to conflict of law provisions.
Licensor reserves the right to modify this Agreement at any time. Updated terms will be reflected in the App. Continued use of the App after changes constitutes acceptance of the modified Agreement.
The App is free to download and use, subject to a daily question limit and a one-time free practice-exam attempt. To remove these limits and unlock additional study features, you may purchase one of the following In-App Purchase options through your Apple ID:
Payment. Payment will be charged to your Apple ID account at confirmation of purchase. All transactions are processed by Apple; Licensor does not have access to your payment information.
Auto-Renewal. The Monthly and Annual subscriptions automatically renew at the price stated above unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the price of the selected plan.
Managing and Cancelling Subscriptions. You can manage your subscriptions and turn off auto-renewal at any time by going to Settings → [your name] → Subscriptions on your iOS device. No cancellation of the current subscription is permitted during the active subscription period.
Free Trial. Any unused portion of a free trial period is forfeited when you purchase a subscription during that trial.
Lifetime Purchase. The Lifetime option is a one-time, non-consumable purchase that grants permanent access to all Premium features on your Apple ID. It can be restored on any device signed in to the same Apple ID using the "Restore Purchases" option in the App.
Pricing. Prices are listed in U.S. dollars and may vary in other regions based on Apple's pricing matrices.
Refunds. Refund requests are handled by Apple. To request a refund, visit reportaproblem.apple.com.
