End User License Agreement

This End User License Agreement ("Agreement") is between you ("User") and YoDaddyDesigns LLC ("Licensor") for the use of PharmTech Ready ("the App"). By downloading or using the App, you agree to the terms of this Agreement. If you do not agree, do not download or use the App.

1. License Grant

Licensor grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple devices that you own or control, solely for your personal, non-commercial educational purposes, subject to the terms of this Agreement and the Apple Media Services Terms and Conditions.

2. License Restrictions

You may not:

1. Copy, modify, or distribute the App or its content
2. Reverse engineer, disassemble, or decompile the App
3. Sell, rent, lease, sublicense, or lend the App to any third party
4. Use the App's questions, flashcards, or explanations to create derivative works or competing products
5. Remove, alter, or obscure any copyright, trademark, or proprietary notices
6. Use the App in any way not expressly authorized by this Agreement

3. Content Ownership

All content within the App, including questions, answers, explanations, flashcard text, graphics, user interface design, and software code, is owned by YoDaddyDesigns LLC and is protected by copyright, trademark, and other intellectual property laws.

4. User Data

The App stores study progress, quiz results, bookmarks, and preferences locally on your device. If you use iCloud, this data syncs across your devices through your personal iCloud account. Licensor does not collect, access, or store any user data on external servers. See our Privacy Policy for details.

5. Educational Purpose Only

The App is an exam preparation tool and does not guarantee certification, employment, or any particular outcome. The App does not provide medical or pharmaceutical advice. Content may not reflect the most current drug information, regulations, or clinical guidelines. Users should always verify information through official and current sources.

6. No Warranty

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

IN NO EVENT SHALL LICENSOR'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP.

8. Apple App Store Terms

This Agreement is between you and YoDaddyDesigns LLC only, not with Apple. Apple has no obligation to furnish maintenance or support services for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.

Apple is not responsible for addressing any claims relating to the App or your possession or use of the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation.

Apple and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right to enforce this Agreement against you as a third-party beneficiary.

9. Termination

This license is effective until terminated. Your rights under this license will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

10. Governing Law

This Agreement shall be governed by the laws of the United States, without regard to conflict of law provisions.

11. Changes to This Agreement

Licensor reserves the right to modify this Agreement at any time. Updated terms will be reflected in the App. Continued use of the App after changes constitutes acceptance of the modified Agreement.
